Terms of Service

1. Agreement to These Terms
These Terms of Service ("Terms") are an agreement between you and Baltimore Property Records ("we," "us," or "our"), the operator of baltimorepropertyrecords.com (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service Is
The Service provides informational access to public property records for Baltimore City and Baltimore County, Maryland — including assessments, permits, code violations, and housing inspections — compiled from government open-data sources. The Service is an independent publication of public records. It is not an official government service and is not affiliated with, endorsed by, or operated by the State of Maryland, Baltimore City, Baltimore County, or any government agency.
3. Informational Use Only — No Professional Advice
All information on the Service is provided for general informational purposes only. It does not constitute legal, financial, investment, tax, or real-estate advice, and it is not a substitute for the official records maintained by government agencies. Records may be incomplete, outdated, or contain errors introduced at the source or during processing. Before making any decision that depends on property information — including purchasing, bidding, lending, or litigation — verify the information against official sources such as the Maryland State Department of Assessments and Taxation (SDAT) and the applicable city or county land records office.
4. Not a Consumer Reporting Agency (FCRA)
Baltimore Property Records is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"), and the Service does not provide "consumer reports." You may not use the Service or any information obtained from it, in whole or in part, to determine any person's eligibility for credit, insurance, employment, housing or tenant screening, or for any other purpose regulated by the FCRA. Using the Service for any FCRA-regulated purpose is a material violation of these Terms and will result in termination of your access.
5. Data Sources and Accuracy
Records are sourced from public open-data programs, including the Maryland State Department of Assessments and Taxation (via Maryland Open Data), Open Baltimore, and Baltimore County Open Data. These sources publish their data "as is," and we republish it on the same basis. We do not warrant that any record is accurate, complete, or current, and we have no obligation to update any record on any schedule. Property records may include names of owners and sale information as recorded in public records; publication of a record does not imply anything beyond its presence in the underlying public source. If you believe a record is inaccurate, the authoritative correction path is the government agency that maintains the source record; you may also contact us and we will review the record's handling on our side.
6. Accounts
Some features require an account. We use passwordless sign-in: you provide an email address and receive a single-use sign-in link. You are responsible for maintaining access to your email account and for all activity under your account. You must provide an email address you control. We may suspend or terminate accounts that violate these Terms.
7. Acceptable Use
You agree not to:
- use the Service for any FCRA-regulated purpose (Section 4);
- use information from the Service to harass, stalk, threaten, intimidate, or harm any person, including persons named in public records;
- scrape, crawl, bulk-download, or systematically extract data from the Service, or circumvent rate limits or access controls;
- resell, redistribute, or offer the Service's data as part of a competing product or dataset;
- use the Service in any way that violates applicable law;
- interfere with the operation or security of the Service.
We may throttle, suspend, or terminate access that we reasonably believe violates this section.
8. Subscriptions and Paid Features
The Service is currently free. We may offer paid subscription features ("Pro") in the future. If we do:
- pricing, billing frequency, and renewal terms will be disclosed clearly before you subscribe;
- subscriptions that renew automatically will renew until cancelled, and you will be able to cancel at any time through your account, by a method at least as easy as the one you used to subscribe;
- where required by law (including Maryland's automatic-renewal law), we will send advance notice before a renewal;
- unless stated otherwise at purchase, fees are non-refundable except as required by law, and cancellation stops future renewals rather than refunding the current period;
- we may change Pro features or pricing with notice; price changes take effect at your next renewal.
9. Intellectual Property
The Service's software, design, organization, and original content are owned by us and protected by applicable law. The underlying public records are government data in which we claim no ownership. We grant you a limited, revocable, non-exclusive license to access the Service for its intended informational use. This license does not permit the bulk extraction or redistribution prohibited by Section 7.
10. Disclaimer of Warranties
THE SERVICE AND ALL INFORMATION IT CONTAINS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR RELIANCE ON ANY INFORMATION IN IT — INCLUDING DECISIONS TO PURCHASE, BID ON, FINANCE, OR FORGO INSPECTION OF ANY PROPERTY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, including any use of Service data for FCRA-regulated purposes or to harm any person.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect the Service or its users. Sections 3–5 and 9–15 survive termination.
14. Changes to the Service or These Terms
We may modify the Service or these Terms. If we make material changes to these Terms, we will post the updated Terms with a new effective date and, for material changes affecting account holders, provide notice by email or on the Service before they take effect. Continued use after the effective date constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Service must be brought exclusively in the state or federal courts located in Baltimore, Maryland, and you consent to their jurisdiction. Nothing in this section limits rights you hold under consumer-protection law that cannot be waived.
